The U.S. Chamber of Commerce and several other business groups on Wednesday sued the Federal Trade Commission in Texas federal court over the commission's vote to ban noncompete clauses, which are used to block employees from leaving to work for competitors in the same industry. On Tuesday, the FTC voted to enact the ban on the basis that noncompete clauses stifle the efficiency of the labor market, hinder competition and can lead to higher prices for consumers. The business groups claimed that the FTC's ban, "breaks with centuries of state and federal law." In addition to the Chamber of Commerce, the Business Roundtable, Texas Association of Business and Longview Chamber of Commerce are all plaintiffs in the suit. The FTC suggested that instead of relying on noncompete clauses, companies should look to other safeguards of information, like nondisclosure agreements.

New York CNN —A federal judge on Thursday ordered Sam Bankman-Fried to repay more than $11 billion as part of his sentence for defrauding customers and investors in his failed crypto exchange FTX. In their sentencing memorandum earlier this month, federal prosecutors laid out their reasoning for seeking $11 billion in forfeiture. Unlike restitution, where the money from seized assets goes directly to victims, the money from forfeiture is taken by the government and absorbed into the US Treasury. It is unclear how much Bankman-Fried is currently worth, but it’s likely not anywhere near $11 billion. So far, the Department of Justice has redistributed about $4 billion to Madoff’s victims.

A Tennessee manufacturer has been fined nearly $300,000 for employing children as young as 14 to operate “dangerous machinery” and requiring them to work more hours than the law allows, federal regulators said. Tuff Torq Corp., which manufactures outdoor-power-equipment components for brands that include John Deere, Toro and Yamaha, must pay a civil penalty of $296,951 and follow federal child labor laws in the future, the Labor Department said in a statement on Monday. The company must also set aside $1.5 million in profits related to the employment of the 10 children who were found to be working at its factory in Morristown, Tenn. That money, the Labor Department said, “will be used for the benefit of the children employed illegally.” A department spokesman said the children were as young as 14. A 19-year-old student pilot from Northern Virginia who tried repeatedly to enter the cockpit of an Alaska Airlines flight from California to Virginia earlier this month is facing a federal charge of interfering with a flight crew, according to court documents. The man, Nathan Jones, was traveling on Alaska Airlines Flight 322 from San Diego International Airport to Washington Dulles International Airport on March 3 when he “interfered and intimidated flight crew members and attendants,” according to an affidavit filed the next day in the District Court for the Eastern District of Virginia. Federal prosecutors on Friday announced charges against a German businessman, alleging he scammed investors out of more than $150 million in a crypto fraud scheme. But in actuality, Jicha and two unnamed co-conspirators, both USI Tech executives, lured and defrauded investors in a "multilevel marketing scheme," prosecutors allege. Around the spring of 2017, Jicha and his co-conspirators began "aggressively promoting" USI Tech, prosecutors said. In 2018, as regulators began scrutinizing USI Tech, prosecutors alleged that Jicha terminated the company's U.S. operations, preventing investors from withdrawing their money. Since then, around $150 million of that money has been transferred to accounts controlled by Jicha, prosecutors said Friday.

Aylo, Pornhub’s parent company, will pay a $1.8 million fine and compensate the sex trafficking victims as part of a deferred prosecution agreement. The company pleaded not guilty to the government’s charge of engaging in unlawful monetary transactions involving sex trafficking proceeds, although it acknowledged the illegal material was posted on its site and said it regrets that fact. The government did not accuse Aylo itself of violating any federal sex trafficking laws, but said the company should have known it was doing business with a group that was engaging in sex trafficking. And Aylo became aware of a federal lawsuit against the production company in 2017, court documents show. In a statement, Aylo, which is under new management since the alleged incidents occurred, said it “deeply regrets” that Pornhub hosted the content.
